Physiotherapy & Hand Therapy Treatment Packages
Motus Health prides itself on providing a great patient experience and supporting patients to achieve their goals. Research tells us that to achieve great outcomes clinician input is required across the course of the rehabilitation period.
Motus treatment packages are pre-paid for four or six physiotherapy or hand therapy sessions. Treatment packages are not available at all clinics.
- The Treatment Package is for Physiotherapy and/or Hand Therapy services only.
- The Treatment Package is valid for 12 months from the date of purchase, after this time any unused entitlements will expire.
- Treatment Packages are not transferable between clients and are non refundable
- ACC and Private Treatment Packages can only be used for their respective services.
- The Treatment Package cannot be exchanged for cash.
- Cancellations made within 4 hours of your appointment, or non-attendance will result in forfeiture of that appointment from the Treatment Package.
- Treatment Packages are for use at the clinic where they are purchased, any transfer to another clinic will be at the discretion of Motus Health.
- Appointment times are subject to availability, but we will endeavor to meet your needs.
- The Treatment Package discount cannot be used in conjunction with any other discount.
- If ACC ceases cover or denies a claim for an ACC Treatment Package, Motus Health will refund the value of the Treatment Package, less the standard cost of services already used. Alternatively, the ACC package can be upgraded to the Private package.
- Motus Health reserves the right to change these terms and conditions at any time.
Pilates Studio Memberships Terms & Conditions
Definitions
The terms “we”, “us”, and “our” refer to Motus Health Limited, trading as Back in Motion Pilates.
The term “Studio” refers to the Pilates facilities at Motus Health locations.
The terms “I”, “you”, “your”, and “applicant” refer to the person(s) whose name(s), signature(s), and initials appear on this document.
The term “studio members” refers to anyone using the Studio facilities.
Membership Period
- You agree that you will join the Back in Motion Pilates Studio from the Commencement Date to the Expiry Date specified on the Contract Form (“the Membership Period”).
- During the Membership Period, you agree to pay the full Fee for the Membership or Package Deal by the Payment Type and Payment Option on the Payment Date(s) by the original expiry date as specified in the Contract Form. We will not be obliged to give you a refund or stop any Automatic payments from you if you fail to use your Membership, extend your membership, or stop attending the Studio before the Expiry Date, except where attendance becomes impossible due to medical reasons (with supporting evidence provided to Motus Health’s reasonable satisfaction), or if Motus Health materially changes services or this contract in a way that adversely affects your membership.
- Membership options and prices are subject to change annually. We will provide notice by email or other contact details provided by you, or by public notice in the Studio.
- During the course of your Membership, you are entitled to place your Membership on hold for a minimum of 2 weeks and a maximum of 8 weeks. This will cost $20 and must be paid in full prior to placing the Membership on hold. The Membership Period will be extended by the same number of days that the Membership is placed on hold, commencing from the original Expiry Date.
- When purchasing a supervised membership, please be aware your supervised sessions are to be used within the Membership Period and cannot be carried over or split into more sessions than are offered.
- We can terminate your Membership immediately, without notice for any breach of these Conditions or for any serious or repeated breach of the Studio Guidelines. If we terminate your Membership, you will not be entitled to a refund of your Membership Fee.
Membership Entitlements
- Your Membership or Package Deal entitles you to the use of the Studio facilities including changing rooms, toilet, cubbies, and water filter. It does not include personal consultations with physiotherapists, or supervised sessions unless specified within the Membership or Package Deal as set out on the Contract Form.
- We cannot guarantee available times within the Studio for either supervised or unsupervised sessions; bookings are on a first-come-first-served basis.
- Cancellation of one-on-one supervised sessions requires a minimum notice period of 8 hours. When cancellation is less than this notice period, you accept that your session entitlement has been forfeited and cannot be later redeemed.
- Memberships are non-transferable and valid only at the location where it was purchased.
Studio Guidelines
- You must comply with the Studio Guidelines and all applicable Health and Safety requirements. We reserve the right to require you to leave the premises immediately if you fail to comply with Studio Guidelines or Health and Safety requirements or if you carry out any activity which we consider offensive or a danger to yourself or others.
- Pilates instructors may use professional, appropriate physical contact to assist with form or reduce injury risk, consistent with standard Pilates practice.
- The studio can be booked for a maximum of 60 minutes per session. Time may be extended at the discretion of the Pilates Instructor.
Code of Conduct
- Treat studio members, Motus Health team members, and members of the public with respect, courtesy, and sensitivity. Derogatory language or harassment will not be tolerated.
- Failure to comply with the Code of Conduct may result in termination of your contract. The decision of Motus Health staff in this regard will be final.
Your Responsibilities
- If you cause any damage to Motus Health facilities, you are liable for the cost of repair or replacement.
- Motus Health premises have a zero-tolerance policy for the use or solicitation of illicit drugs. Involvement in such activities will result in immediate termination of membership.
- If any person(s) under the age of 18 accompany you on premises, you are responsible for their compliance with Studio Guidelines and Health and Safety requirements. You are liable for any damage caused by them.
- You must notify Motus Health staff of any condition that may increase your risk while using the Studio, including illness, injury, or pregnancy. You agree to seek medical advice if you have any health concerns before participating. You understand that use of equipment involves an inherent risk of injury or death.
Our Liability to You
- Consumer Rights: You have rights under the Consumer Guarantees Act 1993 (CGA), which guarantees that services will be provided with reasonable care and skill. If you are receiving health services from a registered health professional, you are also protected under the Health and Disability Commissioner Code of Health and Disability Services Consumers’ Rights Regulations 1996 (the Code).
- Privacy: The personal information you provide in this Contract Form is collected and held by Motus Health. It is used to evaluate your membership application and to provide you with services. You have the right to access and correct your personal information under the Privacy Act 2020. We may use your information to inform you of other services, improve our customer service and marketing, or invite you to participate in surveys, unless you opt out.
- Property: We are not liable for any personal belongings that are lost, stolen, or damaged while on Motus Health premises.
- Limitation of Liability: Except where we are in breach of the CGA or the Code, and provided that we have exercised reasonable care and skill, Motus Health shall not be liable to you or any other person for any direct, indirect, or consequential loss, damage, injury, or expense arising from your use of the Studio or our services, howsoever caused.
